Judges at War: The Politics of the Thai Judiciary

Once one of the most revered public institutions, the Thai judiciary is presently regarded by many as a major accomplice of the elite to undermine constitutional democracy and suppress civil rights. This talk aims at examining the role of judges amidst the so-called lawfare, an ongoing legal battle between the authoritarian government and those yearning for a better future. It will try to offer answers about who these judges are and why those who hold dear the idea of judicial prestige and virtues become anti-democratic and suppressive. How does the regime recruit judges into their rank? The talk will look at what the two courts in focus, the court of justice and the constitutional court, have done and what could possibly be their fates. Lastly, it will discuss what we have yet to know about the Thai judiciary.
